1. Who we are and how these terms apply

HOP is operated by HOP COMMERCE LTD. In these Terms, “HOP”, “we”, “us” and “our” mean HOP COMMERCE LTD. Your purchase contract is with HOP COMMERCE LTD. Our company number is 17436447. Our registered office is Office 7504, 58 Peregrine Road, Hainault, Ilford, Essex, United Kingdom, IG6 3SZ. You can contact us at support@hopdesign.net. For return routing, please use the process in our Returns and Refunds Policy.

These Terms cover our online store and its information, content, tools, products and services. They should be read with our Shipping Policy, Returns and Refunds Policy and Privacy Policy. Our Contact Information page provides our customer-service contact details.

The separate EU Consumer Addendum also applies to the consumer purchases it describes and takes priority over inconsistent provisions in these Terms or our other store policies. Nothing in our terms or policies excludes or restricts mandatory consumer rights. Any more favourable rights we expressly give you remain available.

The terms and product information provided when you place an order apply to that order. Please read and keep a copy of them. By placing an order, you agree to the applicable purchase terms. Our Privacy Policy explains our use of personal information; accepting these Terms is not consent to optional marketing or other processing that requires separate consent.

2. Accounts and information you provide

You must have the legal capacity to make a purchase. If you allow a minor to use the store under your supervision, you are responsible for providing the necessary permission and supervision required by applicable law.

Please provide accurate and up-to-date information needed for your order, including contact, payment and delivery details, and tell us promptly if it changes. You must be authorised to use the payment method you provide.

Keep your account credentials secure and tell us promptly if you suspect unauthorised use. You may not sell, transfer or license your account. This section does not make you liable for activity for which you are not responsible under applicable law.

3. Products and orders

We make reasonable efforts to describe and show products accurately. Screen settings may affect how colours appear, but this does not remove your right to receive goods that match their description and satisfy applicable quality and conformity requirements.

We may change listings, discontinue products or limit quantities for future purchases. Changes to a listing do not retrospectively change an accepted order. Purchases are for personal or household use, not commercial resale or commercial export.

Placing an order is an offer to purchase. Your order is accepted when we confirm acceptance. We must receive and process your payment before acceptance. We may decline an order for a legitimate reason, such as unavailability, suspected fraud or a payment problem. If we cannot accept your order after taking payment, we will notify you and refund that payment without undue delay, within any legally required deadline.

Please check your order before submitting it. Contact us promptly if you want to correct or cancel it. We may be unable to stop a parcel after dispatch, but dispatch or order acceptance does not remove any cancellation, withdrawal or other consumer right you have. Returns, refunds and exchanges are explained in our Returns and Refunds Policy and, where applicable, the EU Consumer Addendum.

4. Prices payment and promotions

The product price applicable to your order is the price shown when you place it and recorded in your order confirmation. Future price changes do not change an accepted order.

The amount payable to HOP and the applicable delivery charge are disclosed before you submit your order. Any additional charges for a non-EU purchase must be disclosed before purchase as required by applicable law. Accepting these Terms does not mean that you agree to unspecified additional charges. For deliveries covered by the EU Consumer Addendum, we bear import duties, import VAT and customs-clearance or related carrier handling charges; you are not required to pay these import charges.

Prices may differ from those charged by other retailers. Promotions may have separate conditions made available before purchase. Those conditions govern the particular promotion, but do not override mandatory rights or the EU Consumer Addendum.

You agree to pay the charges to which you agreed when placing the order using an authorised payment method. We do not impose additional payments without the consent required by applicable law.

5. Delivery and responsibility for goods

Available destinations, delivery charges and delivery arrangements are shown for your destination before purchase and described in the applicable Shipping Policy. Eligibility may depend on the product and delivery address. These Terms do not expand or restrict the destinations available through the store.

The dispatch and delivery periods disclosed for your destination and agreed for your order apply. We will tell you before purchase if a different arrangement applies to a particular order. A particular estimated date is not a separately guaranteed appointment unless we expressly agree otherwise. This does not remove any delivery commitment or remedy you have under your contract or applicable law.

If a delay affects your order, we will let you know and explain the available next steps. Carrier or customs delays do not automatically remove our responsibility to you. If a parcel is missing, damaged or incomplete, contact us with your order number. We will work with the carrier and provide any replacement, refund or other remedy required by your rights.

For delivery arranged by us, the goods remain our responsibility until you, or a person you nominate other than the carrier, takes physical possession. If you independently commission a carrier that we did not offer, different statutory risk rules may apply. Your mandatory rights remain unaffected.

6. Cancellations returns and faulty goods

To arrange a return, email support@hopdesign.net. We will provide the correct return address and return process. Our Returns and Refunds Policy explains how to notify us, send goods back and receive a refund. Contacting us for the correct return address is a routing step, not a requirement to obtain our approval before exercising a right to cancel. You pay the direct return postage for a change-of-mind return, where disclosed before purchase; we cover necessary return postage for faulty goods or other issues that are our responsibility under your consumer rights.

Our change-of-mind return period does not limit rights relating to faulty, damaged, incorrect or misdescribed goods. Where a remedy is required by law, it is provided by us as the seller and is not dependent on a manufacturer agreeing to help. Sale items retain their statutory rights.

You can also submit a return or cancellation request through your HOP customer account when the option is available for your order. We review requests before processing them; submitting a request does not automatically approve a refund. You may continue to exercise your right to withdraw by email or another legally valid method, and that right does not depend on our approval.

7. Intellectual property and feedback

The store's branding, design, text, images, video, audio and other protected content belong to HOP or the relevant rights holder. You may use the store for personal, non-commercial purposes. Except as permitted by law, you may not reproduce, distribute, commercially exploit or create derivative works from protected content without the relevant permission. No ownership or wider licence is granted by these Terms. Shopify's marks belong to Shopify; other third-party marks belong to their owners.

If you submit reviews, suggestions or other feedback for use in connection with the store, you grant us a worldwide, perpetual, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that feedback to operate, improve and promote our products and services, to the extent permitted by law. This does not authorise use of your personal information contrary to our Privacy Policy or applicable law, or transfer ownership of your feedback to us.

You must have the necessary rights to submit feedback, disclose relevant incentives, and avoid unlawful, misleading or rights-infringing content. We may remove content that breaches these requirements. We are not obliged to pay for feedback, keep feedback submitted for public use confidential, or respond to every submission. Private order and support communications are handled under our Privacy Policy and are not treated as public reviews merely because you send them to us.

8. Third party tools and Shopify

Our store may link to third-party sites or provide optional third-party tools. Their own terms and privacy policies may apply. Review those terms before using them. We do not control independent third-party sites or guarantee their availability. Nothing in this section excludes responsibility we have under applicable law for our own acts, services or representations.

Shopify provides the platform that powers our store. Purchases are made directly from HOP COMMERCE LTD., not Shopify. Shopify is not the seller of our goods. This explanation does not waive any rights you may have against Shopify under applicable law.

Personal information is handled as described in our Privacy Policy. Shopify's own processing is also described in its Consumer Privacy Policy.

9. Lawful use and automated access

You must not use the store for unlawful or malicious purposes, fraud, impersonation, harassment, infringement of others' rights, unsolicited advertising, malware or interference with the store's security or operation. You must not collect other people's personal information without a lawful basis, bypass access controls, or misuse store content for unauthorised extraction or resale.

Automated access is prohibited except for an Agent complying with the conditions below or access we otherwise expressly authorise. This exception resolves the relationship between the general access rule and the Agent conditions; it does not permit prohibited scraping, misuse of personal information or circumvention of security controls.

An “Agent” is software or a service that acts autonomously or semi-autonomously for a person or organisation. An Agent accessing the store must:

Identify itself and its name in HTTP or HTTPS requests using “Agent/” followed by its actual name in its user-agent string.
Not conceal that it is automated, impersonate a human, or complete or circumvent a CAPTCHA intended to distinguish humans from automated access.
Answer truthfully when asked whether an interaction is automated.
Respect access restrictions and any request from us to stop accessing the store.

We may limit how Agents access the store. These conditions do not require you to disclose account credentials to an Agent or override applicable privacy or security requirements.

10. Errors and changes to services

We may correct mistakes in information about future purchases. If an error affects an order you have already placed, we will contact you. We will not charge a higher price or substitute a materially different product without your agreement. Any right to cancel an affected order is subject to applicable law, including your right to a refund where payment has been taken.

We may change or withdraw store features for legitimate operational, legal or security reasons. This does not remove our obligations concerning accepted orders or your accrued rights.

11. Access suspension and termination

We may suspend or end access to the store where reasonably necessary to address a serious or repeated breach of these Terms, unlawful activity, fraud, security risks or a legal requirement. Where appropriate and practicable, we will explain the reason and allow a reasonable opportunity to resolve the issue. Immediate action may be necessary to prevent harm or comply with law.

Suspension or closure of an account does not by itself cancel an accepted order or remove your rights to delivery, cancellation, refunds or remedies. Amounts lawfully due remain payable. Provisions that are intended to continue, such as intellectual-property rights and the resolution of existing claims, continue only to the extent permitted by law.

12. Legal guarantees and responsibility for loss

We do not promise that access to the website will always be uninterrupted or error-free. General information on the website is not individual professional advice. These points do not exclude our responsibility for accurate contractual information, goods sold or any mandatory legal guarantee.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law prohibits its exclusion. Your statutory rights concerning ownership, description, quality, conformity and remedies remain fully available.

We are responsible for loss or damage to the extent required by applicable law. Any exclusion of loss that was not reasonably foreseeable or of business-related loss applies only where legally permitted and fair in your circumstances. We do not require consumers to give a blanket indemnity for using the store or to reimburse losses caused by our own breach. Responsibility for a breach by either party is determined by applicable law.

13. Transfer interpretation and the whole agreement

We may transfer our rights and obligations only in a way that does not reduce your contractual or statutory rights. We will provide any notice required by law. You may not transfer your account; any transfer of purchase-contract rights or obligations remains subject to applicable law and any consent lawfully required.

If a provision is not binding or enforceable, the rest of the contract continues where it can do so without that provision. We will not interpret an unclear consumer term against you where applicable law requires a consumer-favourable interpretation. A failure to enforce a right immediately does not waive it.

These Terms and the information and policies forming part of your purchase contract govern the purchase. They do not exclude information, promises or representations that are binding under applicable law, or liability for misrepresentation that cannot lawfully be excluded.

14. Consumer rights complaints and courts

For questions or complaints, email support@hopdesign.net with your order number and a description of the issue. Asking us to investigate does not prevent you from exercising legal rights or using a competent court or applicable dispute-resolution procedure.

You retain the protection of mandatory law that applies to you. You may bring proceedings before any court available to you under applicable law. We may bring proceedings against a consumer only before a court permitted by applicable law. These Terms do not require exclusive proceedings in the country of our registered office, mandatory arbitration or a waiver of consumer court rights.

15. Changes to these terms

We may revise these Terms for future orders and future use of the store. We will give any notice required by applicable law. The version and contractual information provided when an order was placed continue to govern that order unless a change is required by law or we validly agree a change with you. A later website visit does not, by itself, mean you agree to change an existing purchase contract.
